Community rallies as Oak Harbor football coach recovers from assault

A well-known Oak Harbor youth football coach who suffered a serious brain injury following an alleged assault has made remarkable progress, but is still recuperating as the community rallies to help him and his family.

Tyson Boon, a 2006 graduate of Oak Harbor High School, ended up at Harborview Medical Center Sept. 9 after he was punched outside of Mi Pueblo in downtown Oak Harbor.

Boon said in an interview Thursday that he remembers much of the Saturday night at the restaurant up until being injured, but then can?t recall anything until he woke up at the hospital five days later. He was among a group of people celebrating his friend?s retirement that night.

A 30-year-old South Whidbey man allegedly punched Boon in the mouth, according to Oak Harbor Police. The suspect hasn?t been charged as detectives continue to investigate the case.

Boon said that his friends later told him that he wasn?t looking when he was punched and fell to the ground.

Boon?s lip was ripped open and the force of the impact broke the back of his skull and caused bleeding in the front of his brain. He was airlifted to Seattle and remained in intensive care until the following Thursday.

Boon?s wife, BreAnna, said he had a lot of difficulties early on. He wasn?t able to walk for days, he had trouble performing simple tasks and difficulty speaking. She said he was visited by about 50 family members and friends, but didn?t recognize many people or remember them afterward.

As can occur with head injuries, Tyson was very agitated after regaining consciousness. He got angry and struck out at doctors and nurses.

Two weeks later, he?s improved greatly and even returned to coaching the Oak Harbor Youth Football League.

?It?s up and down, depending on the day,? he said.

He?s going to physical, speech and occupational therapy. He doesn?t experience the blinding headaches anymore, but he said it feels like there?s a weight inside his skull.

He has trouble remembering things.? BreAnna said this week he drove her to her parent?s house, thinking that they were dating and she still lived there.

?We?ve been married five years,? she said.

One of the worst things, Tyson said, is that he can?t pick up his 1-year-old son, also named Tyson. The doctor won?t let him pick up anything larger than 10 pounds.

?He?s used to me picking him up and throwing him in the air,? Tyson said, explaining that the little guy waits at the window until he returns from appointments.

Tyson said he?s hoping to go back to work in October, but it will be up to doctors to decide. He works for his uncle as a dairy farmer and drives a truck, making deliveries to dairy farms throughout the region.

Fortunately, the family has a lot of support from the community. Boon was born and raised on Whidbey Island.

He?s part of the third generation of Boons to live on the island. In fact, Boon Road is named after his family.

To help the family with expenses, friends have been raising money. The ?Tyson Boon Account? was set up at Wells Fargo bank to give people a way to donate. A friend set up a stand to raise money outside of Albertson?s and others had a bake sale at Fort Nugent Park.

His sister, Sarah Reinstra, has organized the Tyson Boon Benefit Garage Sale and Bake Sale. It will be from 8 a.m. to 4 p.m., Saturday, Oct. 13 at the Oak Harbor Christian School gym on E. Whidbey Avenue.

People who want to donate to the garage or bake sale can drop off items at the home of Tyson?s parents, Les and Joan Boon, at 372 SW Fourth Ave. in Oak Harbor.

Mosaic Artist Creates New Art Out of Broken China

Cleo Mussi's playful and humorous objects are all made out of broken bits of china and porcelain. Found in charity shops, auction houses and factories, she uses the pieces to create something new out of the old.

Mosaics are magical because from a distance they look like solid objects but up close you see the incredible detail that comes from the hundreds of tiny pieces of china that have been painstakingly glued together.

The fragments from old china and broken tea pot handles and smashed plates all have a history and resonance. When made into a new object, suddenly the flowers and figures and bridges and pagodas form something bigger and more complex than the individual pieces.

Qatar Airways flight to Nigeria declares emergency

LAGOS, Nigeria (AP) ? Nigerian aviation officials say a Qatar Airways flight from Doha to Lagos will need to make an emergency landing because it has problems with its landing gear.

Harold Demuren, director-general of the Nigerian Civil Aviation Authority, told The Associated Press that the flight Saturday declared an emergency prior to its arrival to Lagos. Demuren said firefighting equipment and personnel were standing by for the arrival of Flight No. QR592 at Lagos' Murtala Muhammed International Airport.

Officals with Qatar Airways could not be immediately reached for comment. The company's website showed the Airbus A330-300 aircraft had an estimated arrival time of 1 p.m. local time (1200 GMT).

Sony starts delivering Ice Cream Sandwich update to Xperia go, Xperia U and Xperia sola

Well, it looks like Sony's in-house software developers have decided this is the perfect week to deliver delicious treats to a large portion of the company's mobile lineup. Not long after outing updates for the Tablet S and Xperia Ion (in the US), the electronics giant is now bringing Ice Cream Sandwich to handsets such as the Xperia go, Xperia U and Xperia sola. The refresh itself brings a slew of novel traits to the trio of Xperia slabs, including a "new way to experience" music, photos and video, improvements to the lockscreen, the ability to resize widgets and the addition of a "multitasking" button. While the standout features remain the same across the board, the Xperia sola does get an added bonus in the form of a so-called, self-explanatory glove mode -- which is made possible by the device's "floating touch" technology. Sony does note that availability of the 4.0 upgrade will vary by market and, not surprisingly, carrier requirements. Let's just hope you get to enjoy the changes soon.

In an age when a client?s unhappy experience at a skin care facility can go viral in mere minutes, the importance of superior customer service is very evident. Sure, horrible customer service incidents involving your spa are few and far between; however, reports of exceptional service may be just as scarce. You just can?t seem to move the needle significantly in a positive direction. The problem often is that you?re trying to train your team members in customer service when you should be educating them. Training teaches employees what actions to take in specific situations. Education teaches them how to think about service in any situation and then choose the best actions to take.

Differences between training and educating result in two distinctly different types of service. ?Trained? employees provide basic service. They?ll do just enough to get clients out of their hair, but they won?t make them feel very good about the spa. In fact, sometimes they?ll make the clients feel bad.

Great service is not just about following a procedure or a sequence of steps; it?s about applying their attitude and heart to proven service principles; taking the right actions at the right time to provide uplifting service so your clients and team members feel great about your skin care facility. Service education allows you to make that important distinction.

Real service education means employees learn to think and act differently in service so that their actions always create value for someone else. Service education is more than teaching employees to deliver predictable service or handle client complaints; it?s a foundation for creating a culture of uplifting service in a skin care facility.

Infusing service education into your spa?s culture is a vital process, requiring dedication from the top down and action from the bottom up. Following are a few important points to consider about service education.

UK regulator outlines LIBOR overhaul

(AP) ? Britain's financial regulator on Friday laid out a 10-point plan to overhaul the handling of a key global interest rate that has been the subject of a scandal involving major banks across multiple countries.

Barclays bank agreed in June to pay a $453 million fine to U.S. and British agencies after admitting it had submitted false information for the London Interbank Offered Rate, or LIBOR, which is used to price trillions of dollars in financial contracts, including mortgages. Other firms are being probed in the scandal, which has undermined public trust in banks and damaged the reputations of British financial regulators.

The new plan proposes that bankers convicted of manipulating the rate face criminal penalties and that a new agency take over management of LIBOR. It also calls for tougher controls on banks involved in the rate's calculation.

"Although the current system is broken, it is not beyond repair," said Martin Wheatley, managing director of the Financial Services Authority, the main regulator, as he announced recommendations from the review of LIBOR ordered by the British government.

The FSA said Friday that the rate-fixing scandal was an industry-wide problem which tore "the very fabric that our financial system is built on".

The British Bankers' Association, a trade group, sets the LIBOR every morning after about a dozen international banks submit estimates of what it costs them to borrow. Regulators in the U.S., Britain, Switzerland and other countries allege some banks, including Barclays, purposefully submitted fake numbers to have the LIBOR set at a rate that better suited them.

Wheatley recommended that the handling of LIBOR be stripped from the British Bankers' Association, which "clearly failed" in administering the rate

He accused the BBA of being careless in policing LIBOR, putting too much trust in a system lacking "the right level of checks and balances." Wheatley said he is setting up an independent panel to lead the appointment process for a new group to run Libor, inviting other groups to apply to take over the role and that he wants the new managing body to draw up a code of conduct and carry out regular audits.

The BBA said the review was an "essential step" toward reforming Libor and signaled it would accept Wheatley's recommendation to hand oversight to a new administrator.

Wheatley also proposed that banks submitting rates be subject to formal approval. More banks should be encouraged to submit rates to make the LIBOR benchmark more representative, while the publication of individual submissions should be held back for three months to help prevent manipulation, he said.

He proposed that the FSA continue to be the main regulator.

Britain's Treasury expressed support for the "comprehensive and practical recommendations" laid out in the review, while Bank of England governor Mervyn King called for a swift implementation of the proposals.

So far, Barclays is the only bank which has been identified as submitting false reports of the rates it expected to pay to borrow from other banks, although several other banks ? including Citigroup Inc., Royal Bank of Scotland and JPMorgan Chase & Co. ? are known to be under investigation.

(AP) ? The suspect in Colorado's deadly movie theater attack was barred from university property for threatening a professor, prosecutors said in court documents released Friday, raising more questions about why campus police didn't report his actions to other authorities.

The revelation conflicts with the university's statements that James Holmes was denied access to non-public parts of the campus because he had withdrawn from school.

The name of the person Holmes allegedly threatened has been blacked out. In court testimony Aug. 30, University of Colorado psychiatrist Lynne Fenton, also a professor at the school, said she contacted campus police after meeting with Holmes on June 11.

University officials did not immediately return a message seeking comment.

After weeks of secrecy surrounding the case, most of the documents filed in court were released to the public on Friday. But the release failed to answer several key questions about the July 20 tragedy ? including what allegedly drove Holmes to commit the attack and what, if anything, the University of Colorado did once he reportedly threatened people there.

Holmes, 24, faces 152 charges in the July 20 shooting at an Aurora movie theater during a special midnight showing of the new Batman movie, "The Dark Knight Rises." The attack killed 12 people and injured 58 others.

Defense attorneys claim Holmes is mentally ill. Documents show Holmes' defense team includes a psychiatry expert, who was not identified, and legal experts presume that Holmes will plead not guilty by reason of insanity.

Just minutes before the shooting, Holmes tried unsuccessfully to call Fenton, defense attorneys have said.

Fenton also received a notebook in the mail from Holmes that reportedly contains descriptions of a violent attack, attorneys said. The package was seized by police from a university mailroom after the shooting.

Defense attorneys don't want it to be used as evidence, saying it's protected by doctor-patient privilege.

In the documents released Friday, prosecutors say the professor reported the threats and that Holmes was denied access to campus "as a result of these actions."

The documents show defense attorneys say the prosecutors' allegations are false, based on university statements.

In court, prosecutors suggested Holmes was angry at the failure of a once promising academic career and stockpiled weapons, ammunition, tear gas grenades, and body armor as his research deteriorated and professors urged him to get into another profession. Chief Deputy District Attorney Karen Pearson said Holmes failed a key oral exam in June, was banned from campus and began to voluntarily withdraw from the school.

Not all documents are included in those released Friday. Judge William Sylvester kept from the public documents that contain privileged information, an arrest affidavit that contains details of the investigation, and subpoena and search warrant requests that contain address and names of witnesses.

Documents filed in the case from now on will be public, unless prosecutors or defense attorneys ask they not be released.

Grenade-launcher 'hoax' gets filmmaker arrested

An Arizona man was arrested after posting a video showing a 16-year old boy walking the streets of Phoenix with a fake rocket-propelled grenade launcher. The man said the incident was staged to test police response time following the deadly theater shooting in Colorado. TODAY's Natalie Morales reports.

PHOENIX -- Police have arrested an Arizona man who allegedly filmed his 16-year-old nephew walking city streets dressed in a sheet and carrying a fake grenade launcher, authorities said on Wednesday.

Michael David Turley, 39, was arrested Monday over the making of the video, in which an unidentified narrator says he aims to discover how quickly police in Phoenix would respond following the fatal shooting of 12 people at the screening of the ?Dark Knight Rises? Batman movie in Aurora, Colorado, in July.

The?bizarre, amateurish video?depicts a person with a fairly realistic but fake grenade launcher walking around a Phoenix intersection in what appears to be a blue sheet with dark material covering his head and face.

Made eight days after the shooting at a screening of a Batman movie, the film was posted on YouTube and titled, "Dark Knight Shooting Response, Rocket Launcher Police Test."

"Given this event, I wanted to run a little test here in Phoenix, Arizona," the narrator says in the film. "I want to find out how safe I really am, and I want to know the response time of the Phoenix police department."

The filmmaker claims it took 15 minutes for police to respond.

The first officer finds the filmmaker and the teen standing in a driveway.?The officer calmly tells the boy to put down the weapon and the man to put down the camera. He didn't draw his gun.

Officer James Holmes, a police spokesman, said Turley told the officer they were just filming a movie, and the officer took down their names and left.

After interviewing people who called 911 and later seeing the video posted on YouTube, police arrested Turley.

"It surprised us that he actually put that video on YouTube," Holmes said.

Not 'fun and games'
Holmes said the police response took just over three minutes from the first call, and a helicopter and SWAT team was dispatched as backup.

Turley was charged with knowingly giving a false impression of a terrorist act, endangerment, contributing to the delinquency of a minor and misconduct involving a simulated explosive.

He is being held in county jail on a $5,000 bond. If convicted, he faces up to 45 months in prison, said Maricopa County Attorney's Office spokesman Jerry Cobb.

"We take something like this seriously," Phoenix police spokesman Officer James Holmes said. "It wasn't fun and games to all the people who were affected by this. We don't behave like this in this country to prove a point."

The 16-year-old has not been arrested, Holmes said.

"The video told us what Turley was intentionally trying to do -- creating a terrorist hoax for his own personal ideals," he said.

Turley doesn't have a listed phone number. He didn't immediately respond to messages sent Wednesday through the YouTube account.

An attorney for Turley could not be immediately reached for comment.

Qualcomm unveils new Snapdragon S4 Play ... - Know Your Cell











Qualcomm on Wednesday announced the addition of two new Snapdragon S4 mobile processors: the MSM8225Q and MSM8625Q. Both are members of the Snapdragon S4 Play processor family and are optimized specifically for mid-range and entry-level smartphones.

The new Snapdragon S4 Play processors offer OEMs both dual-core and quad-core CPUs at a discounted rate, possibly making handsets cheaper overall. Both chips will be ready for customer sampling by the end of this year.

With lower-end smartphones being taken to the next level, seeing a high-end chip for lower-end smartphones is great news. An S4 in any handset will likely make it an HD powerhouse with amazing battery life.

In terms of features, bot CPUs support 720p displays and video encoding and decoding. Both also have Wi-Fi, Bluetooth 4.0 and FM connectivity using the Qualcomm Atheros AR6005 and WCN2243 chips. They are really top of the class in almost every way.

All in all, it's nice to see Qualcomm getting serious about the low-end. It has the high-end sewed up and soon it will seemingly have the low-end. We here at KYC can't wait to see what else Qualcomm might have up its sleeves.

Both of Qualcomm's new S4 Play processors are expected to ship in commercial devices in the first quarter of 2013.

Mitt Romney provided nuance to his proposed tax cuts, saying they must fit his goal of reducing federal deficits. But left unanswered is the question of how this will affect the middle class.

"Don't be expecting a huge cut in taxes, because I'm also going to be closing loopholes on deductions," Mr. Romney said Wednesday in Westerville, Ohio, flanked by a national debt clock, chronicling the nation's rising burden on future taxpayers.

The comments in some ways raise as many questions as they answer.

On one hand, they may be aimed in part at addressing skeptics who say Romney's tax plan is "mathematically impossible." He wants to lower the deficit by cutting spending while keeping tax revenues neutral. To do the latter, he would cut income tax rates across the board by 20 percent and make up the difference by eliminating some deductions and credits. Wednesday's comments could be a nod to the scope of those proposed deduction eliminations.

Yet, according to a recent independent analysis, such a plan could result in the unpopular prospect of a net tax decrease for the wealthy and a net tax increase for the middle class.

In general, many tax experts endorse the concept Romney is talking about: reducing tax rates while also reducing or eliminating many deductions or credits to "broaden the base" of income that is subject to taxation. The idea is that a simpler tax code will be more efficient at both gathering federal revenue and stimulating strong economic growth ? even if the reform makes no change in total federal revenue.

The independent review of Romney's proposals, released in August by the Tax Policy Center in Washington, did not claim to be an official "scoring" of the plan, because "certain components of his plan are not specified in sufficient detail." But the analysis did examine the implications of key Romney ideas. Those include the 20 percent cut, being revenue neutral, eliminating the Alternative Minimum Tax, and maintaining current tax breaks for savings and investment.

Even if Romney completely eliminates remaining tax breaks for high-income households, the net effect effect would be a tax decrease for them, the study concluded. Meanwhile, the reductions in tax breaks on other households would be large enough to result in a "net tax increase" for them, it added. Otherwise, it concluded, Romney's goal of revenue neutrality wouldn't be met.

The candidate's comments Wedensday, which offered no new details about his tax plan, leave this math question about deductions unanswered.

"I don?t interpret this as evidence that Governor Romney wants to increase taxes on the middle class in order to cut taxes for the rich, as an Obama campaign ad claimed," Tax Policy Center director Donald Marron wrote in a blog shortly after the controversial study was released. "Instead, I view it as showing that his plan can?t accomplish all his stated objectives."

But a Romney adviser this week suggested that there could be another solution. In a debate between economic advisers affiliated with the two presidential campaigns, pro-Romney economist Kevin Hassett echoed the thought that Romney would put a priority on not raising taxes for the middle class.

Mr. Hassett, an American Enterprise Institute economist and an informal adviser to Romney, predicted that if the Romney math doesn't add up, Romney's response would be to scale back the cut in tax rates in order to avoid asking middle-class families to provide more tax revenue.

Chart shows households with student loans

(AP) ? With college enrollment growing, student debt has stretched to a record number of U.S. households ? nearly 1 in 5 ? with the biggest burdens falling on the young and poor.

The analysis by the Pew Research Center found that 22.4 million households, or 19 percent, had college debt in 2010. That is double the share in 1989, and up from 15 percent in 2007, just prior to the recession ? representing the biggest three-year increase in student debt in more than two decades.

The increase was driven by higher tuition costs as well as rising college enrollment during the economic downturn. The biggest jumps occurred in households at the two extremes of the income distribution. More well-off families are digging deeper into their pockets to pay for costly private colleges, while lower-income people in search of higher-wage jobs are enrolling in community colleges, public universities and other schools as a way to boost their resumes.

Because of the sluggish economy, fewer college students than before are able to settle into full-time careers immediately upon graduation, contributing to a jump in debt among lower-income households as the young adults take on part-time jobs or attend graduate school, according to Pew.

As a share of household income, the debt burden was the greatest for the poorest 20 percent of households, or those making less than $21,044. In all, 40 percent of U.S. households headed by someone younger than age 35 owed college debt, the highest share of any age group.

"Comparing the debt to their economic resources, the lowest-income fifth of households are the ones experiencing the greatest stresses," said Richard Fry, a senior economist at Pew who analyzed the numbers.

Noting that college enrollment has continued to climb since 2010, Fry added: "Until college enrollment peaks, I would not expect the amount of outstanding student debt to level off."

The study released Wednesday is based on the Survey of Consumer Finances, conducted every three years and sponsored by the Federal Reserve. The numbers are as of 2010, the latest available for that survey. Separate Fed data have pointed to subsequent increases in student loans since 2010 that totaled $914 billion in the April-June quarter, but don't provide demographic breakdowns on who shoulders the biggest burdens.

Both President Barack Obama and his Republican challenger in this year's election, Mitt Romney, have been seeking to court young voters with differing visions on how to address rising tuition and growing college debt. Obama wants to make tax credits for college expenses permanent and expand Pell grants for lower-earning families. Romney says that making government the direct source of federal student loans has not worked and simply drives tuition higher. He stresses the need to curb college costs.

The Pew report found that the richest 20 percent of households, or those with annual income of $97,586 or higher, owed the biggest share of outstanding student debt ? 31 percent, up from 28 percent in 2007. The poorest 20 percent of households also saw their debt grow, to 13 percent from 11 percent.

The richest households saw significant increases in per-household debt. For those with annual income of $97,586 to $146,791, college debt rose from $25,921 in 2007 to $31,989. For the richest 10 percent, making at least $146,792, college debt increased from $36,033 to $44,810.

Across all households, the average outstanding college debt increased from $23,349 to $26,682. For the poorest 20 percent of households, the average debt rose from $19,018 to $20,640.

In recent years, Americans have cut back on several other types of borrowing such as credit card use, with average household indebtedness falling from $105,297 in 2007 to $100,720 in 2010. Broken down by income levels, however, average total indebtedness for the bottom 20 percent of households by income actually rose from $17,579 in 2007 to $26,779; for the higher income groups, average indebtedness either was unchanged or declined.

Melatonin and exercise work against Alzheimer's in mice

ScienceDaily (Sep. 26, 2012) ? The combination of two neuroprotective therapies, voluntary physical exercise, and the daily intake of melatonin has been shown to have a synergistic effect against brain deterioration in rodents with three different mutations of Alzheimer's disease.

A study carried out by a group of researchers from the Barcelona Biomedical Research Institute (IIBB), in collaboration with the University of Granada and the Autonomous University of Barcelona, shows the combined effect of neuroprotective therapies against Alzheimer's in mice.

Daily voluntary exercise and daily intake of melatonin, both of which are known for the effects they have in regulating circadian rhythm, show a synergistic effect against brain deterioration in the 3xTg-AD mouse, which has three mutations of Alzheimer's disease.

"For years we have known that the combination of different anti-aging therapies such as physical exercise, a Mediterranean diet, and not smoking adds years to one's life," Coral Sanfeliu, from the IIBB, explained. "Now it seems that melatonin, the sleep hormone, also has important anti-aging effects."

The experts analysed the combined effect of sport and melatonin in 3xTg-AD mice which were experiencing an initial phase of Alzheimer's and presented learning difficulties and changes in behaviour such as anxiety and apathy.

The mice were divided into one control group and three other groups which would undergo different treatments: exercise -unrestricted use of a running wheel-, melatonin -a dose equivalent to 10 mg per kg of body weight-, and a combination of melatonin and voluntary physical exercise. In addition, a reference group of mice were included which presented no mutations of the disease.

"After six months, the state of the mice undergoing treatment was closer to that of the mice with no mutations than to their own initial pathological state. From this we can say that the disease has significantly regressed," Sanfeliu states.

The results, which were published in the journal Neurobiology of Aging, show a general improvement in behaviour, learning, and memory with the three treatments.

These procedures also protected the brain tissue from oxidative stress and provided good levels of protection from excesses of amyloid beta peptide and hyperphosphorylated TAU protein caused by the mutations. In the case of the mitochondria, the combined effect resulted in an increase in the analysed indicators of improved performance which were not observed independently.

Treatment not easily transferable to humans

"Transferring treatments which are effective in animals to human patients is not always consistent, given that in humans the disease develops over several years, so that when memory loss begins to surface, the brain is already very deteriorated," the IIBB expert points out.

However, several clinical studies have found signs of physical and mental benefits in sufferers of Alzheimer's resulting from both treatments. The authors maintain that, until an effective pharmacological treatment is found, adopting healthy living habits is essential for reducing the risk of the disease appearing, as well as reducing the severity of its effects.

The melatonin debate

The use of melatonin, a hormone synthesized from the neurotransmitter serotonin, has positive effects which can be used for treating humans. With the approval of melatonin as a medication in the European Union in 2007, clinical testing on this molecule has been increasing. It has advocates as well as detractors, and the scientific evidence has not yet been able to unite the differing views.

According to the Natural Medicines Comprehensive Database, melatonin is probably effective in sleeping disorders in children with autism and mental retardation and in blind people; and possibly effective in case of jet-lag, sunburns and preoperative anxiety.

"However, other studies which use melatonin as medication show its high level of effectiveness," Dar?o Acu?a-Castroviejo explained. He has been studying melatonin for several years at the Health Sciences Technology Park of the University of Granada.

The expert points out that international consensus already exists, promoted by the British Association for Psychopharmacology -also published in the Journal of Psychopharmacology in 2010-, which has melatonin as the first choice treatment for insomnia in patients above the age of 55. This consensus is now being transferred to cases of insomnia in children.

Its use in treating neurodegenerative diseases is acquiring increasing scientific support in lateral amyotrophic sclerosis, in Alzheimer's, and Duchenne muscular dystrophy.

"Even though many more studies and clinical tests are still required to assess the doses of melatonin which will be effective for a wide range of diseases, the antioxidant and anti-inflammatory properties of melatonin mean that its use is highly recommended for diseases which feature oxidative stress and inflammation," Acu?a-Castroviejo states.

This is the case for diseases such as epilepsy, chronic fatigue, fibromyalgia, and even the aging process itself, where data is available pointing to the benefits of melatonin, though said data is not definitive.

Bayer wins early U.S. approval for colon cancer drug

(Reuters) - The U.S. Food and Drug Administration on Thursday approved a new drug for advanced colon cancer developed by Bayer AG, a month ahead of the agency's expected action date for a decision.

The drug, to be sold under the brand name Stivarga, was approved to treat colon cancer that has progressed after prior treatment or that has spread to other parts of the body, the agency said.

"Someone has clearly lit a fire under the FDA," Sanford Bernstein analyst Geoffrey Porges said of the speedy approval. "We're seeing a fairly consistent pattern of drugs for high unmet needs diseases being approved on an expedited basis."

Bayer said Stivarga will be ready for distribution as soon as Friday and set a wholesale price for the drug of $9,350 for a 28-day cycle of treatment.

In pivotal clinical trials, Stivarga - known chemically as regorafenib - helped severely ill patients live on average 1.4 months longer than those who received standard treatment without the Bayer drug. Stivarga plus standard care also delayed tumor growth for an average of two months compared with 1.7 months for standard care alone.

Bayer is currently awaiting a colon cancer approval decision for the drug in Europe and is also seeking U.S. approval of regorafenib as a treatment for gastrointestinal stromal tumors.

"Stivarga is the latest colorectal cancer treatment to demonstrate an ability to extend patients' lives and is the second drug approved for patients with colorectal cancer in the past two months," Richard Pazdur, director of the Office of Hematology and Oncology Products in FDA's Center for Drug Evaluation and Research, said in a statement.

In August, the FDA approved Zaltrap, an advanced colon cancer treatment from Sanofi SA and Regeneron Pharmaceuticals.

Onyx Pharmaceuticals Inc is entitled to a 20 percent royalty payment on global net sales of Stivarga under a settlement agreement with Bayer following a dispute over how closely related the medicine is to Nexavar, the kidney and liver cancer drug that the companies co-developed and share.

Bayer and Onyx will jointly promote Stivarga in the United States.

Porges, Bernstein's biotechnology analyst, called the Onyx royalty agreement, "a fairly attractive deal."

But he said initial sales expectations for Stivarga are relatively modest "because this is really a relatively small indication late in the disease."

However, Morningstar analyst Damien Conover forecast sales of the drug reaching $1 billion by 2020. Bayer declined to provide its own sales forecast for the medicine.

"Bayer has very high expectations for Stivarga," Shannon Campbell, head of oncology for Bayer Healthcare, said in a telephone interview. "We certainly expect that Stivarga is going to play an important role once (patients) have gone through some of the more standard infusion based chemotherapies that are out there."

Stivarga is a pill that works by blocking several enzymes that promote cancer growth.

The drug was reviewed under the FDA's priority review program that provides an expedited six-month review for drugs that offer major advances in treatment or that provide treatment when no adequate therapy exists. A decision had been expected by October 27.

The Stivarga label will include a warning that severe and fatal liver toxicity occurred in some patients treated with the medicine during clinical studies, the FDA said.

In addition to Zaltrap, Stivarga will likely also compete with Roche Holding AG's multibillion-dollar cancer drug Avastin and Erbitux from Bristol-Myers Squibb Co and Eli Lilly and Co.

An estimated 143,460 Americans will be diagnosed with colorectal cancer, and 51,690 will die from the disease in 2012, according to the National Institutes of Health.

Bayer shares rose 1.3 percent to 68.40 euros in Germany.

Onyx shares were up 2.8 percent at $84.85 on Nasdaq.

Gas prices unlikely to fall as fast as oil

Not so fast. That's the message for drivers hoping a recent drop in oil prices will soon show up at the gas station.

Oil has dropped $9 per barrel, or 9.1 percent, in less than two weeks. Gas prices tend to lag changes in oil, but experts don't expect a significant move lower until the middle of October.

Oil ended at $89.98 on Wednesday, down $1.39, or 1.5 percent. The national average price for gas was $3.805 per gallon, a record high for this time of year, and up 31 cents from the same date last year.

Gas prices should be at a record for early October when President Barack Obama debates Republican challenger Mitt Romney next week in Denver. The focus of the debate will be on the economy and domestic policy. High gas prices usually cut into consumer spending, which accounts for about 70 percent of economic activity.

Gas has remained stubbornly high although economic growth is tepid and demand for gasoline is lower than a year ago. Oil rose about 25 percent from late June through late August. More recently, refinery issues have tightened the supply of gas on both coasts. And there are lingering effects from Hurricane Isaac, which disrupted refineries and imported oil deliveries along the Gulf Coast.

Prices are at or above $4 per gallon in Alaska, California, Connecticut, Hawaii, New York and Washington, according to AAA, Wright Express and the Oil Price Information Service. The lowest prices, which range from $3.546 per gallon to $3.656 per gallon, are in Texas, the lower Midwest and the South.

It probably will be a few more weeks before supplies build back up in certain markets and lead to a noticeable decline in pump prices, said Tom Kloza, chief oil analyst at Oil Price Information Service.

He predicted that gas would drop into a range between $3.25 per gallon to $3.50 per gallon by Thanksgiving. The highest price voters ever paid while heading to the polls falls in that range: $3.41 on Nov. 8, 2011. In 2008, when Obama defeated John McCain, gas had dropped to $2.41 by Election Day as the economy slid deeper into recession.

Oil last closed below $90 per barrel on Aug. 2. Wednesday's drop came as protests in Greece and Spain offered visible reminders that Europe still is struggling to resolve its debt crisis. The protests are occurring ahead of spending cuts and tax hikes designed to help those countries control debt. Such austerity measures crimp the need for oil and oil byproducts like gasoline and diesel.

Brent crude, which is used to price international varieties of oil, fell 41 cents to $110.04 per barrel in London.

Other futures prices on the New York Mercantile Exchange:

? Heating oil was flat at $3.1068 per gallon.
